Why we don't offer EPAs in 5 states

Use the official state form — not ours

An honest position. Five Australian states and territories prescribe a statutory EPA form. Use it.

In NSW, Victoria, Queensland, South Australia, and the ACT, the Powers of Attorney Act of that state prescribes the form an Enduring Power of Attorney must take. Using the official prescribed form is the safest path to a valid EPA in those jurisdictions. A third-party version — even one drafted carefully — risks rejection by registries, banks, or care providers.

That's why DYOdocs only offers EPAs in WA, TAS, and NT — the three jurisdictions where no statutory form is prescribed. We'd rather decline to sell a product than sell one that puts your family's authority in question when you most need it.

NSW New South Wales

The prescribed EPA form is set under the Powers of Attorney Act 2003 (NSW). Available from NSW Land Registry Services and NSW Civil & Administrative Tribunal.

✅ All states and territories covered

DYOdocs covers all 8 Australian states and territories: NSW, VIC, QLD, WA, SA, TAS, ACT, and NT. You'll select your state during the questionnaire — your documents are then prepared under the correct governing legislation for your state.

⚠️ EPA structure varies by state

In NSW, WA, SA, TAS, and NT, separate EPA documents are required for Property and for Personal/Health matters. In VIC, QLD, and ACT, a single combined EPA document covers both. The correct EPA structure for your state is handled automatically in the DYOdocs questionnaire.

✅ DYOdocs Australian wills and EPAs are legally valid

❤️ Advance Healthcare Directives — where the DYOdocs directive can be used

The DYOdocs Advance Healthcare Directive is designed for residents of New South Wales, Victoria, Queensland and Tasmania. You'll confirm your state in the questionnaire, and your directive is prepared with the correct signing and witnessing instructions for that state.

⚠️ ACT, NT, SA & WA — the official statutory form must be used

In these four jurisdictions the law requires an advance care/health directive to be made on (or substantially on) the government-approved form. A general directive cannot be substituted, so residents of these states and territories should complete the official form linked below rather than the DYOdocs directive:
