Important Information for Niue Residents
Please read these notes before starting your documents.
Niue customary land is governed by traditional practice and separate customary land legislation. It cannot pass by an ordinary will. If you have customary land, you should seek advice from a Niue legal practitioner about how to address it in your estate plan. A DYOdocs will can still cover all your other assets.
There is currently no EPA (Enduring Power of Attorney) legislation in Niue. If you need to make arrangements for someone to manage your affairs, seek advice from a Niue or New Zealand legal practitioner. New Zealand EPAs are available separately — see above.
Niue wills are governed by the English Wills Act 1837 (as applied in Niue) and the Wills Amendment Act 1969. DYOdocs wills are prepared in compliance with these requirements, including correct Niue signing and witnessing instructions.
- Wills: English Wills Act 1837 (as applied in Niue) · Wills Amendment Act 1969
- Trustee administration: NZ Trustee Act 1956 (as applied in Niue, without subsequent NZ amendments)
- Estate administration / probate: NZ Administration Act 1969 (as applied in Niue, without subsequent NZ amendments)
- Capacity: Persons under 16 who have never been married cannot make a will (Wills Amendment Act 1969, s2(4))
