What property law actually involves

When you buy or sell a property, you’re not just signing a contract — you’re transferring a legal title that’s registered with Land Information New Zealand. The lawyer’s job is to make sure that transfer happens correctly, that you understand what you’re actually buying, and that the money moves safely.
That work includes reviewing the sale and purchase agreement before you sign; running statutory searches against the title (covenants, easements, caveats, mortgages); checking the LIM and the council records; verifying compliance with the Building Act and Resource Management Act where relevant; preparing transfer documents and discharge of mortgage; and handling the settlement — the moment money and title change hands. Funds must be held in a regulated trust account, not a personal one.
For more complex transactions — cross-lease conversions, unit titles, subdivision applications, commercial property, or transferring property into or out of a family trust — the work is more involved still, and the documents have to fit specific statutory frameworks.
