Terms of service for DYOdocs Limited (“DYOdocs”) (trading as DYOdocs, DYOtrusts, and DYOwills)
Thank you for choosing DYOdocs. These Terms of Service ("Terms") govern your use of our Services, which include our website, software, products, and other related services (Services). By using our Services, you agree to be bound by these Terms, including our Privacy Policy. If you are using our Services on behalf of an organisation, you are agreeing to these Terms on behalf of that organisation. Please note that the statements under the "More simply put" section are for your convenience only and are not legally binding or intended to modify these Terms.

DYOdocs legal information is not a substitute for legal advice
DYOdocs provides a license to create legal documents for your personal use, but we do not provide legal advice or services. We do not review any information you input for legal accuracy or sufficiency, nor do we draw legal conclusions or apply the law to your situation.
If you require legal advice, please consult a qualified lawyer licensed to practice in your jurisdiction. Any legal information provided by DYOdocs is not a substitute for professional legal advice. Communications between you and DYOdocs are not protected as privileged communications under the solicitor-client privilege.
By using our Services, you agree that DYOdocs is not your lawyer or legal representative, and we do not create a lawyer-client relationship with you.

Lawyer referral service
DYOdocs is not a "Lawyer Referral Service." The directory of lawyers published on our Service is for informational purposes only and is provided to the public free of charge. We do not endorse or recommend any lawyer, nor do we make any warranty as to the qualifications or competency of any lawyer.
Refund policy
We want you to be satisfied with our Services. If you are not satisfied or believe there has been an error in billing, please contact our Customer Service Department at reception@rossholmeslawyers.co.nz within 30 days of purchase, and we will work with you to resolve the issue or provide a refund or credit that can be used for future Services.
Ownership and preservation of your documents
Any documents you create or upload using our Services belong to you, and we do not claim ownership.
However, we may preserve and disclose them if required by law, to enforce these Terms, to respond to claims that content violates the rights of third parties, or to protect the rights, property, or safety of DYOdocs, its users, or the public.
The technical processing and transmission of the Service may involve transmissions over third-party networks, and we are not responsible for deleting or failing to store any documents or content you maintain or upload.

Consent to receiving emails
By creating an account, you agree to receive communications from DYOdocs, such as newsletters, special offers, and account reminders and updates. You can opt out of promotional emails by clicking the "Unsubscribe" link in the footer of the email. However, you cannot opt out of essential communications regarding your account, such as renewal notices.

No unlawful or prohibited use
You can only use our Services if it complies with the laws of your jurisdiction(s). The availability of our Services in your jurisdiction(s) does not authorize or invite you to use our website or Services in a way that violates your local laws and regulations. You are responsible for ensuring that you do not violate any applicable laws in your jurisdiction(s). We reserve the right to refuse membership or suspend or terminate your account at our discretion.
The following activities are specifically prohibited when using DYOdocs Services:
Use in connection with any legal matter for which you are currently or prospectively represented by legal counsel.
Hacking, "scraping," or "crawling" our Services, whether directly or through intermediaries such as spiders, robots, crawlers, scrapers, framing, iframes, or RSS feeds without express written permission from DYOdocs.
Attempting to access any information DYOdocs has not intentionally made available to you on its Services.
Reselling any DYOdocs content without prior express written consent from DYOdocs.

Intellectual property rights and grant of a license

You may not reproduce, modify, enhance, decompile, disassemble, reverse engineer, distribute, sell, licence, sublicence, rent, lease, or create derivative works of any of our products and Services, except for the documents you create for your personal or business use. You may not circumvent or disable any security or technological features of our products and Services.
The Service Content, including the design, text, graphics, and selection and arrangement of our Services and the legal forms, documents, and guidance, are copyright © DYOdocs.
You are granted a non-exclusive, limited, non-transferable, revocable license to use our Services as intended on these Terms. You own the documents you create using our Services, but you cannot sell or give away the DYOdocs template they are based on.
When you transmit public-facing user content on DYOdocs, you grant us a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display any such content, including throughout the world in any media. If you submit feedback or suggestions about our Services, we may use your feedback or suggestions without obligation or compensation to you.
Any resale or redistribution of our materials requires the express written consent of DYOdocs. Any rights not expressly granted in these Terms are reserved by DYOdocs.

The DYOdocs logo, software, trademarks, products, and Services belong to DYOdocs. You agree not to copy or sell any of our intellectual property. As long as you follow these Terms, you're welcome to use all DYOdocs Services in the manner intended. The documents you create are yours for personal or business use, but you can't sell or give away the DYOdocs template they're based on.
Disclaimer of representations and liability

We provide our Services "as is" and "as available," and we do not make any warranties or representations of any kind, whether express or implied.
To the fullest extent permitted by law, we disclaim all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Legal Information received via DYOdocs should not be relied upon for personal, medical, legal, or financial decisions. We recommend you use information from our Services in conjunction with the advice of a qualified professional tailored to your situation.
We do not warrant that our Services will be uninterrupted or error-free, that defects will be corrected, or that our Services or the server(s) that make them available are free of viruses or other harmful components.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use or inability to use our Services.

By using our Services, you agree to release and hold harmless DYOdocs, its third-party service providers, officers, employees, directors, and agents from any and all losses, damages, expenses, claims, and actions of any kind, including reasonable lawyers' fees and injury (including death), arising from your use of our Services. You also agree to indemnify us and hold us harmless from any losses, damages, expenses, claims, and actions of any kind, including reasonable lawyers' fees and injury (including death), arising from any third-party claims related to your use of our Services, your violation of these Terms, or your violation of another's rights.

Dispute resolution by binding arbitration and class action waiver
PLEASE READ THIS SECTION CAREFULLY, AS IT AFFECTS YOUR RIGHTS.
We strive to resolve all customer concerns through our Customer Service Department or by email. However, if we can't resolve a dispute with you informally, we agree to resolve it through binding arbitration as a condition of using our Services. The arbitration will take place in Auckland, New Zealand, and the first step is to send an email notification of the dispute to the other party.
You agree to only resolve disputes with us on an individual basis and not to bring a claim as a plaintiff or a class member in any class, consolidated, or representative action. Exceptions include DYOdocs' right to bring a lawsuit against you in any court of competent jurisdiction for injunctive relief related to unauthorized use or abuse of our Services or intellectual property infringement.
If the agreement to arbitrate is found to be inapplicable or unenforceable, we agree that any resulting judicial proceedings will take place in the courts of Auckland, New Zealand, and you expressly consent to the venue and personal jurisdiction of those courts by using our Services.

If you have a problem with DYOdocs and customer service can't help, you waive your right to sue us, either individually in court or by class action. Instead, we'll resolve your dispute using private arbitration.
Governing law and jurisdiction
These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be resolved in the courts in Auckland, New Zealand.
Entire agreement
These Terms constitute the entire agreement between you and DYOdocs with respect to the subject matter of these Terms and supersede and replace any other prior or contemporaneous agreements, or terms and conditions applicable to the subject matter of these Terms. These Terms create no third-party beneficiary rights other than as specifically stated in these Terms.

Waiver, severability, and assignment
If we don't enforce a provision of these Terms, it doesn't mean we won't enforce it later. If a provision is found unenforceable, the remaining provisions will still be in effect, and we'll substitute an enforceable term reflecting the intent of the unenforceable language as closely as possible. You cannot assign your rights under these Terms, but we may assign our rights to our affiliates, subsidiaries, or any successor of any business associated with our services.

Changes to Terms
We may modify these Terms at any time, and the revised version will be effective immediately upon posting. If you do not agree with the modified Terms, you should stop using our Services.
