Important information for Sāmoa residents
Three things to know before preparing your Sāmoa documents.
Under s 6 of the Wills Act 1975 (Sāmoa), if a witness to your will is a person who receives a gift under the will (or is the spouse of such a person), that gift will be void. The witness may still prove the will, but they lose their entitlement. Do not use a beneficiary of your will, or the spouse of a beneficiary, as a witness. Choose two independent adult witnesses who do not benefit under the will.
There is currently no EPA legislation in Sāmoa. The EPA product is not available for Sāmoa documents. Sāmoa residents who hold New Zealand-situated assets may purchase NZ Bespoke EPAs from Ross Holmes Virtual Lawyers Limited for those NZ assets only.
Sāmoa wills are governed by the Wills Act 1975 (Sāmoa). Estate administration is governed by the Administration Act 1975 (Sāmoa). DYOdocs wills are prepared in compliance with these requirements, including the correct signing and witnessing instructions for Sāmoa.

- Capacity: Persons under 18 years of age cannot make a will (s 4(2)). No marriage exception, no military exception.
- Witnesses (s 5): Two witnesses, both present at the same time, witnessing the testator's signature in the presence of each other.
- Beneficiary witnesses (s 6): A gift to a witness (or their spouse) is void. Use independent witnesses only.
