There is no EPA (Enduring Power of Attorney) legislation in Samoa. If you need to make arrangements for someone to manage your affairs, seek advice from a Samoa or New Zealand legal practitioner. New Zealand EPAs are available separately if you have New Zealand assets or connections — see above.
Under s6 of the Wills Act 1975 (Samoa), if a witness to your will is a person who receives a gift under the will (or is the spouse of such a person), that gift will be void. The witness may still prove the will, but they lose their entitlement. Do not use a beneficiary of your will, or the spouse of a beneficiary, as a witness. Your DYOdocs signing instructions will include this reminder.
Samoa wills are governed by the Wills Act 1975 (Samoa). DYOdocs wills are prepared in compliance with the capacity and execution requirements of this Act, including correct Samoa signing and witnessing instructions.
